THEMIRK.NET USER AGREEMENT

These Terms of Use (“Terms”) govern all use of Themirk.net (“Themirk.net”).

By using and accessing the Site, you agree to these Terms, the Privacy Policy, other policies, and all applicable laws and regulations. Customers in the EU are subject to the EU Conditions of Use.

If you do not want to be bound by these Terms, do not use the Site.

ALL INFORMATION ON THEMIRK.NET IS FOR INFORMATIONAL PURPOSES ONLY. WE DO NOT PROMOTE OR SELL STEROIDS OR ANABOLIC DRUGS, AND WE ARE NOT RESPONSIBLE FOR ANY ADVERTISING THAT MAY BE PLACED BY ANY MEANS ON OUR WEBSITE: THEMIRK.NET.

1.CHANGES IN TERMS

Themirk.net has the sole right at any time and without prior notice to revise these Terms. Themirk.net will post changes on the Site, and it is your responsibility to review these Terms and any modifications.

2.TERMINATION

Tnemirk.net reserves the right, at any time and without prior notice, to terminate the provision of all or some of the Temirk.net services, as well as to terminate your right to access any page, as well as functions and services of Tnemirk.net.

3.COMPLIANCE WITH LAWS

You agree to comply with all applicable laws and regulations regarding your use of the Site. You must be at least 18 years old to use Themirk.net. See the Safety of Minors section of the Privacy Policy.

4. CONTENT

Any data such as text, recordings, videos, logos, descriptions pictures and other materials on the Site, as well as their assembly and arrangement on the project, is referred to as “Content”.

The content provided may contain errors, omissions, may be out of date, Themirk.net has the right to remove, correct and update the content at any time. The Content is provided for informational and/or entertainment purposes only and is not binding on Themirk.net.

Themirk.net does not grant to you, any person or any business, any right to use, reproduce, copy, modify, transmit, display, publish, sell or resell, redistribute, license, create derivative works, publicly perform, or distribute by any means, method, or process whatsoever, now known or hereafter developed, any of the Content on or transmitted through the Site, in whole or in part, whether for profit.

6. ACCOUNTS

By creating an account on the Site, you agree to provide, maintain and update true, accurate, current and complete information about yourself as required by our registration processes.

7. USER CONTENT

Themirk.net allows you to register accounts and profiles and post content, which may include, but is not limited to, attaching photos, reviews, comments, ideas, suggestions, links to various resources (which the administrator may remove without notice) and other materials.

User Content is non-confidential, has no rights of its own, and may be used by Themirk.net at any time without prior authorization, consent, payment or other consideration unless prohibited by law.

You agree that as a condition of permitting you to submit User Content, you grant Themirk.net, subject to the Privacy Policy, a non-exclusive, irrevocable, royalty-free, worldwide, fully sub-licensable, perpetual right and license to use, copy, publicly perform, digitally perform, publicly display, republish and distribute User Content, including the use of your name, alias, and any other information (provided by you), and to prepare derivative works based on, or incorporate into other works, User Content, with or without attribution. You represent and warrant that any User Content is in compliance with all applicable laws and regulations, and it is not composed of and does not contain viruses, solicitations, or any form of spam. Your submission of User Content constitutes an agreement that you will defend, indemnify, and hold Themirk.net harmless for all claims resulting from User Content you supply.

Themirk.net is not responsible for, and does not endorse, the opinions, information, advice or recommendations in User Content and specifically disclaims all liability in connection therewith.

Themirk.net reserves the right to modify, review, delete and refuse to post User Content for any reason.

Themirk.net cannot guarantee the security of any User Content, and you provide such information at your own risk. Themirk.net has no obligation to monitor any Comments.

If you choose to interact with Themirk.net’s social media account(s) such as Instagram, Facebook, Twitter or any other website, application and/or interactive technology that allows you to create or share/share content, you grant Themirk.net the right to share and/or recycle your content, comments and/or posts that relate to our Site and/or any of our services or products.

8. RULES OF CONDUCT

WITHOUT LIMITING THE FOREGOING, ALL CONTENT PROVIDED ON OR THROUGH THEMIRK.NET IS PROVIDED TO USERS “AS IS,” WITH NO WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, SECURITY, OR ACCURACY. THEMIRK.NET SHALL NOT BE LIABLE TO YOU OR ANY OTHER PERSON OR ENTITY FOR DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES, INCLUDING LOST PROFITS, PERSONAL INJURY (INCLUDING DEATH) AND PROPERTY DAMAGE OF ANY NATURE.

14. DISPUTE RESOLUTION

ARBITRATION OF A DISPUTE, CLAIM OR CAUSE OF ACTION SHALL BE IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

Nothing in this Section shall prevent Themirk.net from seeking injunctive or other equitable relief from the courts for matters related to data security, intellectual property, or unauthorized access to the Site.

15. GENERAL TERMS

1. Entire Agreement/Severability. These Terms of Use, together with the Privacy Policy and any amendments and any additional agreements you may enter into with Themirk.net, shall constitute the entire agreement between you and Themirk.net. If any provision of these Terms of Use is deemed invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms of Use will remain in full force and effect.
2. No Waiver. No waiver of any term of these Terms of Use shall be deemed a further or continuing waiver of such term or any other term, and Themirk.net’s failure to assert any right or provision under these Terms of Use shall not constitute a waiver of such right or provision.
3. Defined Words. Any capitalized words used herein and not otherwise defined are defined in Themirk.net’s Conditions of Privacy Policy, or the applicable policy.
